These Terms & Conditions govern your access to and use of the Boukak website, demo, and loyalty platform, operated by Bitaqat Al Wafi for Information Technology (Commercial Registration No. 2050198251), Dammam, Kingdom of Saudi Arabia. By using our website, trying our demo, registering for a loyalty card, or subscribing as a merchant, you agree to these Terms. If you subscribe as a merchant, your signed subscription agreement with Boukak governs your relationship with us, and these Terms apply to anything that agreement does not cover.

Boukak provides a platform that lets merchants design and run digital loyalty programs, including issuing digital cards, tracking stamps, points, or cashback, sending notifications, and viewing performance reports. Boukak is a technology provider only. We do not sell, redeem, or guarantee any reward, discount, product, or service a merchant offers, and we are not a party to the relationship between a merchant and its customers.

You must provide accurate and current information when registering as a merchant or customer. Merchants are responsible for having the legal right to operate their business and to collect the information they request from their customers.

Merchants agree to:

All stamps, points, cashback, discounts, and rewards are issued and honored solely by the merchant. Boukak has no obligation to provide, fund, or guarantee any reward and is not liable if a merchant fails to honor a reward, closes their business, or ends their loyalty program. Customers should direct any dispute about a reward to the merchant.

Merchant subscription plans, pricing, and included features are described on our pricing page and may change from time to time. Fees are billed as agreed at subscription, and merchants must settle invoices within the agreed payment period. Late payment may lead to suspension of service.

Merchant subscriptions renew automatically for an equivalent term unless either party gives notice of non-renewal before the end of the current term, as described in the signed subscription agreement. Fees already paid for a subscription period are non-refundable, except where we agree otherwise or the law requires it.

Our interactive demo lets you try Boukak's features with sample or temporary data. Demo cards and data are for demonstration only, are not a real loyalty account, and may be reset or deleted at any time without notice.

Cards issued through Boukak may be added to Apple Wallet or Google Wallet. The availability and behavior of these passes depend on Apple's and Google's own terms and services, which are outside our control.

We aim to keep Boukak available and up to date and will make reasonable efforts to fix any interruption promptly. We may carry out maintenance or updates from time to time, which may briefly affect availability.

You agree not to use Boukak to break any applicable law, send unsolicited or unauthorized communications, misuse another party's data, interfere with the platform's security or operation, or attempt to gain unauthorized access to any account or system.

Boukak, its logo, design, and underlying software belong to us and are protected by applicable intellectual property laws. Subscribing to Boukak does not give a merchant any ownership rights in the platform. Custom card or poster designs requested by a merchant are subject to a separate agreement and fees.

To the maximum extent the law allows, Boukak is not liable for indirect, incidental, or consequential damages arising from use of the platform, including losses arising from a merchant's failure to honor its loyalty program commitments to its customers.

We may send notices related to these Terms by email or through your account on the platform, and either method is a valid means of communication.

These Terms are governed by the laws of the Kingdom of Saudi Arabia. Any dispute will first be resolved amicably between the parties; if that is not possible, it will be referred to the competent authority in Dammam, Saudi Arabia.

We may update these Terms from time to time. Changes take effect from the revised effective date shown at the top of this page, and continuing to use our services after that date means you accept the update.
